Our client is searching for a Assistant Legal Advisor to advise in relation to legal risk management issues. The role will principally be concerned with advising an online business which is based, and primarily regulated, in Gibraltar. The Online business also has offices in the UK, Tel Aviv, Bulgaria and Manila. You will be a commercial lawyer who is capable of providing commercially-focused and practical advice on, legal and commercial risk issues on a range of matters.
The majority of such issues will be generated by commercial contracts, which will cover a large number of areas related to the Group?s operations, including software development and licence agreements; financial agreements; marketing and affiliate agreements; customer-facing terms and conditions.
In addition, risk management will be required in relation to intellectual property matters, in particular in relation to the brands which are owned and/or operated by the business. This may include defensive or offensive dispute management, as well as providing general advice related to the existence, extent, defensibility and protection of intellectual property rights which the business owns or comes into contact with.
Dispute resolution with customers and suppliers is also a significant area. Common issues are domain name recovery and dealing with breaches of the Company?s terms and conditions by customers.
Person Specification:
Strong drafting, negotiation and project management skills and experience required on English language and English law contracts, gained in a leading law firm or comparable in-house role. Expected PQE range is 2-4 years.
The person with the role will need to be able to work with minimal supervision on:
? commercial contracts, e.g. software licences, marketing agreements, intra-group agreements;
? marketing campaigns and advertisement and copy clearance;
? data processing and data protection compliance issues;
? general 'first line' legal advice on IP issues connected with marketing (e.g. use of images; protection of Company IP).
Key experience would include:
? Advising on a wide range of commercial contracts, ideally as an in-house lawyer, and ideally in the technology / IP / marketing sector.
? Basic knowledge of IP law, data protection legislation, and consumer law.
? Commercial acumen and aptitude, with a proven ability to analyse legal risk management issues in a pragmatic and commercially-focussed manner.
? Knowledge and experience of diverse business operating structures, including joint ventures and revenue-sharing arrangements.
